DWI

If you are stopped by a Louisiana police officer for DWI or DUI:

  1. You do not have to submit to a field sobriety test. However, if you refuse, your driver’s license will be automatically suspended for six months.
  2. Louisiana Revised Statute 14:98 provides that anyone over the age of 21 with a blood alcohol content (BAC) of .08% is legally drunk; if you are under 21, you are legally drunk with a BAC of .02%.
  3. If your BAC is at or over these levels, you will be arrested for Driving While Intoxicated.
  4. If your BAC is over 0.15%, you must spend 48 hours in jail.
  5. You have only 15 days after a DWI arrest to request a Department of Public Safety hearing to attempt to prevent your license from being automatically suspended.

  2. How many DWI arrests have you had in the past?
  3. Were you accused of any other crimes?
