If you have been accused of domestic violence, you need an attorney who will rigorously defend your case by examining and presenting all the facts in a court of law. A protective order is normally issued to protect a party from further acts of violence. You may face restraining or protective orders prohibiting you from contacting, interacting with, or coming within a certain distance of the person who sought the protective order. You may be prevented from returning to your home and children.

If you are the victim of domestic violence, typically you first seek a temporary restraining to ensure that you and/or your children remain safe during the pendency of a formal hearing. Typically, a formal hearing will be set within 21 days to determine whether the Temporary Restraining Order should be converted to a Protective Order. A protective order can last up to 18 months and can prohibit the defendant from coming within a certain distance of the victim, contacting the victim personally, through a third party, by telephone or through electronic or written communications under penalty of law. A protective order may address other issues such as custody, support, and prohibitions against selling or destroying property.
